POLICY

MINUTES TO NON-PUBLIC MEETINGS

 

The School Board reserves the right to sit in non-public session closed to the public and media when a majority of the members present and voting so vote. The motion calling for a non-public session will indicate the nature of the item to be discussed under the appropriate citation (RSA 91A:3IIa-f):

  1. the dismissal, promotion or compensation of any public employee or the disciplining of such employee, or the investigation of any charges against him/her, unless the employee affected requests an open meeting;
  2. the hiring of any person as a public employee;
  3. matters which, if discussed in public, would likely affect adversely the reputation of any person, other than a member of the body or agency itself, unless such person requests an open meeting;
  4. consideration of the acquisition, sale or lease of property which, if discussed in public, would likely benefit a party or parties whose interest are adverse to those of the general community;
  5. consideration or negotiations of pending claims or litigation which has been threatened in writing or filed against the body or agency or any subdivision thereof, or against any member thereof because of his membership in such body or agency, until the claim or litigation has been fully adjudicated or otherwise settled;
  6. consideration of applications by the adult parole board under RSA 651-A.

The board may entertain a motion to hold a non-public session only for those purposes which the law recognizes. (For the list of reasons permitted by law.) A roll call vote shall be recorded. The time of non-public session along with those persons involved in non-public session shall be recorded in the minutes.

In order to act upon most items considered at non-public session, the Board will convene or reconvene in open session. That such a meeting will be recorded in the minutes of the preceding or subsequent open session of the Board. Board members and any persons attending a non-public session are duty-bound and are expected not to disclose any details of the discussion hold.

Minutes of proceedings in non-public session shall be kept. The minutes must include names of those present in the non-public session, any decisions reached in non-public session, and a brief summary of the "proceedings."

The School Board may, by a 2/3 majority recorded vote, seal the minutes of a non-public session either indefinitely or to a time specific in the future. Minutes may be sealed if the Board believes that divulgence of information contained in them would (1) adversely affect the reputation of any person or (2) render the proposed action ineffective. To release non-public minutes sealed indefinitely, a majority of the Board must determine that circumstances which resulted in the minutes being sealed no longer exist and must vote to release said minutes. If the Board takes no action to seal minutes of a non-public session, the minutes will be available for public inspection within 72 hours of the session and will be reviewed and approved by the Board in its usual manner.
