DRUG-FREE WORKPLACE POLICY

 

      As a recipient of federal grant monies, the Chichester School District is required by the Drug-Free Workplace Act of 1988 and government regulations promulgated thereunder the enact a drug-free workplace policy and to certify to federal agencies which provide grant monies that it will provide a drug-free workplace.  The Chichester School District policy and certification is stated below:

 

1.      Notify all employees in writing through a written statement that the unlawful manufacture, distribution, possession, or use of controlled substances is prohibited in the school district’s workplace and specify the actions that will be taken against employees for violation of such prohibitions.

 

2.      Establish a drug-free awareness program to inform employees of the dangers of drug abuse and of the school district’s policy of maintaining a drug-free workplace; any available drug counseling, rehabilitation, and employee assistance programs; and the penalty that may be imposed on employees for drug abuse violations occurring in the workplace.

 

3.      Make it a requirement that each employee whose employment is funded by a federal grant and each employee engaged in the performance of grants be given a copy of the statement as required by paragraph 1 of this policy.

 

4.      Notify employees in the required statement that as a condition of employment under the grant, the employees will abide by the terms of the statement and will notify the school district of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such conviction.

 

5.      Notify the federal agency within ten days after receiving notice from an employee or otherwise receiving notice of such conviction.

 

6.      Take one of the following actions within 30 days of receiving notice with respect to any employee who is so convicted; take appropriate personnel action against such an employee, up to and including termination; or require such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a federal, state or local health law enforcement, or other appropriate agency.  Any cost of services not regularly covered under the Chichester benefit structure will be the responsibility of the employee who voluntarily chooses to seek assistance or rehabilitation.

 

7.      Make a good faith effort to continue to maintain a drug-free workplace through implementation of all the provisions of this policy.

NOTIFICATION TO EMPLOYEES

 

 

A.       YOU ARE HEREBY NOTIFIED that it is a violation of the policy of the Chichester School for any employee to unlawfully manufacture, distribute, dispense, possess or use in the workplace alcohol or any narcotic drug, hallucinogenic drug, amphetamine, barbiturate, marijuana or any other controlled substance, as defined in schedules I through V of section 202 of the Controlled Substances Act (21 U.S.C. 812) and as further defined by regulations at 21 CFR 1300.11 through 1300.15.

 

“Workplace” is defined as the site for the performance of work done generally or specifically in connection with a federal grant.  That includes school buildings or other school premises; any school-owned vehicle used to transport students to and from school or school activities; off school property during any school-sponsored or school-approved activity, event or function, such as a field trip or athletic event, where students are under the jurisdiction of the school district.

 

YOU ARE FURTHER NOTIFIED that it is a condition of your continued employment generally and specifically on any activity funded through a federal grant that you will comply with the above policy of the Chichester School District and will notify your supervisor of your conviction of any criminal drug statute for a violation occurring in the workplace, no later than 5 days after such conviction.

 

It is the intent of the Chichester School District  that all employees perform responsibly and act in the best interests of students.  Violation of District’s policy as outlined above will adversely affect these goals and is unacceptable, dangerous, and in violation of law.

C.       Any employee who violates the terms of Chichester’s Drug-Free Workplace Policy shall satisfactorily participate in a drug abuse assistance or rehabilitation program approved by the board.  If the violation is deemed serious enough or if the employee fails to satisfactorily participate in such program or if further violations of this policy occur the employee may be non-renewed, suspended or terminated from employment at the discretion of the board in accordance with the collective bargaining agreement, State and Federal law.
